my question is how do i collect the money left in his account after everything has been paid. they sent me a check for the amount to his estate. he
doesn’t have an estate. now the bank says i can’t cash the check because its made to the estate. he did not have a will since he had nothing to leave

    Did someone in your family have power of attorney over your father’s affairs? Did your father leave a will or something that denotes someone as the handler of his affairs after his death? Maybe they can establish some kind of account or fund for your father and the check can go into it.

    you go to the probate court in your county and apply to be named executor of the estate. Then you take that ruling to the bank and they will cash the check. However, if there are outstanding bills, you will be expected to pay for them from the proceeds of the check.

    Rather than hiring an attorney, You might try to go to the court house, and talk to the Probate Judge. He/She is who handles estates, probating wills, etc. Purhaps he/she will give you a little advice!

    If you are the only living heir you are the estate. You must file a petition to the court to tell them you are the heir. Get a lawyer quick. Did you get a Payable opon death on your fathers bank account? If you did then it should go directly to you..
